Standard Licence Agreement
This licence agreement applies to the acquisition of a Standard licence via the BEAT BOARD platform and is binding for sellers (licensor) and buyers (licensee).
1. Parties
A licence agreement is concluded between the producer (hereinafter "licensor") as the author of the beat and the buyer (hereinafter "licensee") via the BEAT BOARD platform. BEAT BOARD acts solely as a mediating platform and is not itself a contracting party.
2. Subject of the licence
The subject of this licence is the use of the beat acquired on BEAT BOARD ("work") according to the following provisions. By purchasing, the licensee confirms that they understand and accept the conditions.
3. Grant of usage rights
The licensor grants the licensee a non-exclusive, temporally and spatially unlimited right to use the work for multiple projects. The licence may be applied to further projects of the licensee, but may not be transferred to third parties.
4. Permitted uses
The licensee may use the work for:
- Music recordings (vocal or instrumental productions)
- Streaming, download and physical distribution (CD, vinyl, etc.)
- Music videos and visual projects
- Advertising, films, series and social media content
- Live performances and public performance
5. Scope of delivery
Under the Standard licence, the licensee receives the untagged WAV file of the beat. An MP3 file may also be included depending on the selected tier. Stems are not part of the Standard licence.
6. Usage restrictions
The following uses are excluded or require a separate agreement:
- No exclusive rights — the licensor may licence the beat to other users
- No claim to authorship — the licensee may not claim to be the author of the beat
- No sale of the beat as a standalone work
- No re-export circumventing the licence
7. Licensor obligations
The licensor warrants that they hold the necessary copyright usage rights to the beat and that it is free of third-party rights that would affect this licence. The licensor indemnifies the licensee against third-party claims arising from a breach of this warranty.
8. Licensee obligations
The licensee undertakes to credit the licensor appropriately upon publication where industry practice applies, and to use the licence only within the scope of this agreement.
9. Remuneration
The purchase price covers the remuneration for granting the usage rights. No further remuneration obligation exists unless individually agreed otherwise. BEAT BOARD charges the seller no sales commission.
10. Warranty and liability
The licensor warrants the contractual condition of the work. Further liability for indirect damages is excluded unless intent or gross negligence exists.
11. Term
The licence is valid from the time of purchase and is unlimited in duration, provided the licensee complies with the conditions of this agreement.
12. Final provisions
German law applies. Invalidity of individual provisions does not affect the rest. Amendments require written form.
